5.8 METHODS OF ENTRY: Sponsor also may elect from time-to-time to designate other location(s) at which Chance to Win Numbers may be obtained, at its discretion, in addition to the options set out in Sections 5.1, 5.2 and 5.7 above. Sponsor is not responsible for Drawing Tickets that are lost, misdirected, garbled, distorted, truncated, incomplete, illegible, damaged, defaced, altered, copied or incorrect for any reason, and all such Chance to Win Numbers are void. Sponsor reserves the right in its sole discretion to disqualify any Chance to Win Numbers at any time that, in its opinion, do not comply with these Official Rules.
6.0 DRAWING AND NOTIFICATION OF PRIZE WINNER:
6.1 GRAND PRIZE DRAWING: The potential winner of the Drawing "Grand Prize" (as defined below) will be selected by random drawing from all eligible entries received during the Entry Period, with the drawing to be held at the Venue or office of Sponsor, and the winning Chance to Win Number (the "Winning Number") posted on https://daytona5050.com/pages/winners, on www.facebook.com/VetTix, and on www.DaytonaInternationalSpeedway.com/5050 (collectively, the "Notifications").
6.2 WEBSITE POSTING: Entrants need not be present to win. The Winning Number for the Drawing shall remain posted at https://daytona5050.com/pages/winners and www.facebook.com/VetTix (the “Website Posting”) following the NASCAR Cup Series: Daytona Race and throughout the "Claims Period" (as defined below) or can be obtained by sending an e-mail to 5050Daytona@VetTix.org.
6.3 GRAND PRIZE CLAIMS PERIOD: In order to be eligible to claim the Grand Prize, the holder of the Winning Number (the “Drawing Winner”) must deliver the Winning Number to a Sponsor representative between the conclusion of the Entry Period and August 14, 2026 at 11:59 PM ET (the "Claims Period") by sending the Winning Number to the Sponsor at Sponsor’s address, which will be provided to the Drawing Winner upon request. The Drawing Winner may reach out to Sponsor via email at 5050Daytona@VetTix.org to make an initial Winning Number claim, but the Sponsor reserves right to require delivery of the actual Winning Number to Sponsor’s address. Any transportation required for the Drawing Winner to make delivery of the Winning Number shall be the Drawing Winner's sole responsibility and will not be furnished or paid for by the Sponsor or Venue. The original Winning Number (as displayed on the Drawing Ticket) is the only valid receipt for claiming the Grand Prize. If an individual loses or has their Drawing Ticket stolen, and that Drawing Ticket is redeemed because it contains the Winning Number, the original purchaser of the Drawing Ticket acknowledges the “Released Parties” (as defined below) have no liability to the original Drawing Ticket purchaser related to any prize awarded to the then-current Drawing Ticket holder.
6.4 WINNER VERIFICATION: The potential winner shall be required, at the time the potential winner delivers the Winning Number to Sponsor, to provide his or her mailing address (the "Mailing Address") and telephone number, to execute and deliver to Sponsor an Affidavit of Eligibility and Liability/Publicity Release provided by Sponsor, in a form acceptable to Sponsor in its sole discretion, to complete a W-2G tax form, and present two (2) forms of identification satisfying the requirements for completion of the W-2G, including or as well as at least one (1) valid government-issued photo identification during the Claims Period. Upon presentation of the Winning Number to Sponsor during the Claims Period, and verification by Sponsor that it bears the Winning Number and is the authentic Drawing Ticket containing the Winning Number (with the date upon which the Winning Number is presented to Sponsor being hereinafter referred to as the "Delivery Date"), Sponsor will photograph the Winning Number and shall provide the Drawing Winner with written verification that he or she has won the Drawing. Upon compliance with the foregoing provisions, Sponsor shall mail a check in payment of the Grand Prize, less the "Withholding Amount" (as defined below), if any, to the Drawing Winner at the Mailing Address no later than (30) days following the Delivery Date.
6.5 TAX DOCUMENTATION & WITHHOLDING AMOUNT: As required, the Drawing Winner may be issued Internal Revenue Service ("IRS") tax forms or other required documentation and/or reporting forms for the value of the prize awarded, and is solely and exclusively responsible for any and all state, federal or local income taxes that may result from his or her acceptance of the prize. Sponsor is required by law to withhold and remit to the IRS on any winner's behalf an amount equal to twenty-five percent (25%) of any prize awarded (the "Withholding Amount") if the value of such prize exceeds USD$5,000, and the winner is a citizen or resident alien of the United States with a Social Security number (different rules as promulgated by the IRS apply for nonresident aliens and for resident aliens and citizens of the United States who do not have a Social Security number) or as otherwise required by law.
6.6 DISQUALIFICATION: Sponsor will award the Grand Prize only upon verification of the Drawing Winner and the Winning Number in Sponsor's sole discretion. Decisions by Sponsor as to the Drawing Winner's eligibility and acceptance or disqualification will be final and binding. If the potential winner has not complied with these Official Rules, including the timely delivery of the Winning Number, the provision of his or her photo identification and another acceptable form of identification as noted above, Mailing Address and telephone number, and the execution of the Affidavit of Eligibility and Liability/Publicity Release and W-2G tax form during the Claims Period, the Grand Prize will be forfeited and shall be retained by the Sponsor. In the event the potential winner does not accept the Grand Prize, is disqualified for any reason, or fails to comply with these Official Rules, the Grand Prize will be forfeited and shall be retained by the Sponsor. Upon prize forfeiture, no compensation will be given to the potential winner. Failure of any potential winner to sign any requested document or failure of any potential winner to comply with any terms in these Official Rules may disqualify the winner in the Sponsor's sole discretion and the potential winner may forfeit the Grand Prize.
6.7 FORFEITURE OF GRAND PRIZE: If no entrant presents the Winning Number to Sponsor prior to the end of the Claims Period in accordance with the procedures set forth above, the Grand Prize will be forfeited and shall be retained by the Sponsor. The Grand Prize will not be awarded to any other person. Sponsor will not be required to attempt to notify or locate the holder of the Winning Number in any manner other than by making the Notifications and making the Website Posting. Sponsor also will not be responsible if the holder of the Winning Number leaves the Race before the Notifications are made, is not in his or her seat when the Notifications are made, does not hear or see the Notifications, does not inquire in-person at the Guest Services Information Desk, does not check the Website Posting or call the Sponsor Telephone Number, is otherwise unaware that he or she has the right to collect the Grand Prize, or does not present the Winning Number at one of the designated locations within the required time as set forth in these Official Rules. If the holder of the Winning Number attempts to deliver the Winning Number to Sponsor and collect the Grand Prize outside the Claims Period, he or she will be notified that the Grand Prize has been forfeited.
7.0 GRAND PRIZE: The holder of the Winning Number shall be entitled to receive, upon compliance with these Official Rules, the greater of: (a) fifty percent (50%) of the Net Drawing Proceeds; or (b) FiftyThousand Dollars (USD $50,000.00) (the "Grand Prize"). "Net Drawing Proceeds" shall mean total Drawing Proceeds received during the Entry Period less (i) any contractually-agreed upon royalty payments (i.e., license fees payable in connection with the use of third-party technology) and (ii) the Withholding Amount. In the event that the Drawing Winner, on the date that the Grand Prize is claimed, has an outstanding, past-due balance with the Sponsor, Sponsor is authorized to withhold up to one hundred percent (100%) of the Grand Prize in settlement of all or a portion of such outstanding debt, as applicable. For purposes of clarification, Sponsor will withhold only that amount necessary to satisfy the outstanding debt. Any and all remaining Grand Prize amounts shall be issued to Drawing Winner in accordance with the terms and conditions of these Official Rules.
8.0 PRIZE RESTRICTIONS AND ODDS: The Grand Prize is not transferable or assignable and cannot be substituted for another prize. Any and all taxes, fees, and other costs including, but not limited to, federal and, if applicable, state and local income and withholding taxes that may arise and be due or asserted on the value of the Grand Prize are the sole responsibility of the Drawing Winner. Odds of winning the Grand Prize depend on the number of eligible entries received.
9.0 PUBLICITY RELEASE: The Drawing Winner agrees that acceptance of the Grand Prize grants to Sponsor, the Venue, the DIS, and each of their respective related entities, the right to print, publish, broadcast, and use world-wide and in perpetuity, in any media now known or later developed, at any time or times, the winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including, but not limited to, in advertisements, publicity, and other communications without additional compensation, except where prohibited by law.
10.0 LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES. As a condition of entering the Drawing and by accepting a Chance to Win Number, each entrant agrees that: (1) under no circumstances will the entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, special, exemplary, incidental, consequential, or any other damages, other than actual out-of-pocket expenses, if any; (2) all causes of action arising out of or connected with the Drawing or any prizes awarded shall be resolved individually, without resort to any form of class action; and (3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and will not include attorneys' fees and costs. BY ENTERING THE DRAWING, THE DRAWING WINNER AGREES TO RELEASE, DISCHARGE, INDEMNIFY, DEFEND AND HOLD HARMLESS VETERAN TICKETS FOUNDATION., DAYTONA INTERNATIONAL SPEEDWAY, LLC, NATIONAL ASSOCIATION FOR STOCK CAR AUTO RACING, INC., BUMP WORLDWIDE, INC. In the event a Released Party is found liable to an entrant who has commenced a claim, the Released Party’s maximum liability to the entrant under all any headings of damage or expense reimbursement claims is the greater of either (a) $50.00, or (b) reimbursement of the amount donated to the Sponsor related to the acquiring of the Chances to Win Number(s).
10.1 By participating in the Drawing, entrants agree that the Released Parties: (a) are not responsible for technical failures of any kind, including but not limited to lost, disconnected, interrupted, or unavailable network, server, or other connections, late, lost, undeliverable, damaged or stolen mail, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for Chance to Win Numbers that for any reason are not properly distributed or presented by any deadline stated above; (b) are not responsible for any incorrect or inaccurate information, whether caused by entrants or other participants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Drawing or in the printing of these Official Rules, administration of this Drawing, or in the selection or announcement of the Winning Number for the Grand Prize; (c) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this Drawing or downloading of any software or materials; (d) are not responsible for unauthorized human intervention in any part of the Drawing; (e) are not responsible for any unauthorized third party use of any Drawing-related materials; (f) are not responsible for the inability to select a winner because of postal failure, equipment failure, or data storage failure; and (g) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Drawing, the distribution of Chance to Win Numbers, the selection of the Winning Number, the Grand Prize or otherwise in any Drawing-related materials.
